The Tufnells of Langleys, Great Waltham Part 2

 
Fourth Generation

10.  Samuel Jolliffe Tufnell (John Jolliffe 3, Samuel 2, John 1) was baptised on 4 Jan 1748 in Great Waltham, Essex, died on 9 May 1820, aged 72, and was buried on 17 May 1820. He had no known marriage and no known children.

General Notes: Samuel Jolliffe Tufnell, esq of Langleys in the parish of Great Waltham, Essex: commission and inquisition of lunacy, into his state of mind and his property. Date: 8 10 1794.

Samuel, the eldest son of John Jolliffe, the first, was born in January, 1748-49. He was feeble-minded, and died unmarried in 1820, aged seventy two. He was buried in Pleshy Church.

11.  William Tufnell (John Jolliffe 3, Samuel 2, John 1) was born on 24 Dec 1749, died on 17 Jul 1814, aged 64, and was buried in Pleshey, Essex.

General Notes: His [Samuel's] younger brother, William, who was born on 13th December, 1749, lived with him at Langleys to take care of him and manage his affairs. He married Ann, daughter of John Close, Esq., of Easeby Hall, co. York. He predeceased his brother by six years, and was buried at Pleshy on 23rd July, 1814. His wife erected a monument to him, which may still be seen in Pleshy Church, which says " by unremitting acts of benevolence he conferred happiness on all around him, and fulfilled every relative duty in life with integrity and kindness."

William married Anna Close on 20 Sep 1777. Anna was baptised on 13 Apr 1759 in Richmond, North Yorkshire and died in 1824, aged 65.

12.  John Tufnell (John Jolliffe 3, Samuel 2, John 1) was baptised on 11 Jun 1753 in Great Waltham, Essex and died in 1829, aged 76.

General Notes: I, John Tufnell, of Wallops in the county of Essex, esquire, do hereby revoke all wills, codicils and other testamentary dispositions at any time or times heretofore by me mad and do declare this to be my last will.

I give and bequeath unto my dear wife, Hannah Tufnell, the sum of two thousand pounds to be paid to her immediately after my death for her absolute use and benefit.

I also give and bequeath to my said wife all the plate, linen, china, wines, liquors, household furniture and provisions which I shall die possessed of for her own use and benefit.

I give and bequeath unto Ann Blyton who has lived in my service a great many years the sum of three hundred guineas to be paid within six calendar months after my decease.

I give and bequeath unto my eldest son John Tufnell of Horkstow Hall in the county of Lincoln, esquire, William Green of Salisbury Square in the City of London, gentleman, and Edward Leigh Pemberton of the same place, gentleman, their executors, administrators and assigns all and singular the leasehold messuages, lands and tenements and all the rest, residue and remainder of my personal estate and effects whatsoever or wheresoever which I shall be possessed of or entitled unto at the time of my dearth or shall have power to dispose of or appoint by this my will to have and to hold the same respectively upon and for the trusts, intents and purposes and with, under and subject to the powers, provisos and declarations hereinafter declared and contained of and concerning the same, that is to say:

Upon trust that they the said trustees or the survivors or survivor of them or the executors, administrators or assigns of such survivor do and shall with all convenient speed after my decease call in and compel payment of or use their or his endeavours to compel payment of the debts which shall be due and owing to me or such of the same debts as my said trustees or trustee for the time being shall in their or his absolute or uncontrolled discretion think it advisable to attempt to compel payment of other than such of the same debts as shall be charged upon government or real security and do and shall convert into money all my leasehold estates for years and such other parts of my personal estate hereinbefore bequeathed to my said trustees as shall not consist of money or debts and do and shall by and out of the monies which I shall be possessed at the time of my death and the money which shall arise by such calling in, sale and conversion into money as is hereinbefore directed to be made.

In the first place pay and satisfy all my just debts and funeral and testamentary expenses and to pecuniary legacies which I give by this my will or shall give by any codicil or codicils hereto and do and shall lay out and invest the surplus of the money which I shall die possessed of and which shall arise by the ways and means aforesaid in the purchase in the names or name of the said trustees or the survivors or survivor of them or the executors or administrators of such survivor of a competent share or competent shares of any of the parliamentary stocks or public funds of Great Britain or at interest upon government or real securities in England and do and shall alter, vary and transpose the same stocks, funds and securities and also the government and real securities of which I shall be possessed at their or his pleasure (yet so that every such alteration, variation and transposition as shall be made during the life of my said wife, Hannah, shall be with her consent in writing).

And do and shall stand and be possessed of and interested in all and singular the said trust monies, stocks, funds and securities (including as well the government or real securities of which I die possessed as the stocks, funds or securities in or upon which the surplus of the monies of which I shall die possessed and of the monies to arise by such calling [illegible] and conversion into money as is hereinbefore directed shall be laid out and invested) and the dividends, interest and annual produce thereof respectively upon the trusts and for the intents and purposes and [illegible] under and subject to the powers, provisos and declarations hereinafter declared and contained of and concerning the same (that is to say):

Upon trust to pay the dividends, interest and annual profits which shall arise therefrom from the time of my decease to or permit the same to be received by my said wife, Hannah, and her assigns for the term of her natural life and from and immediately after her death, in case she shall survive me or if she shall die in my lifetime, then from and immediately after my own death as to and concerning one equal moiety or half part of the said trust monies, stocks, funds and securities upon trust for my said son, John Tufnell, his executors, administrators and assigns for his and their own use and benefit absolutely.

And as to, for and concerning the other moiety or half part of and in the said trust monies, stocks, funds and securities upon trust forthwith to appropriate and set apart so much or such part thereof as shall on the day of the death of my said wife, in case she shall survive me or in case she shall die in my lifetime, then as shall on the day of my own death be worth the sum of four thousand pounds of lawful money of Great Britain and do and shall pay, transfer or assign the fund so to be appropriated to my granddaughter, Louisa Tufnell, the daughter of my son William Bewley Tufnell in case she shall be married or have attained the age of twenty one years at the death of my said wife or at my own death as the case may be but in case she shall be under age and unmarried at the time aforesaid then upon trust then they the said trustees or trustee for the time being do and shall pay and apply the dividends, interest and annual produce of the funds so to be appropriated and set apart or such part of the same dividends, interest and annual produce as they in their discretion shall think fit to or for the maintenance and education of the said Louisa Tufnell in the mean time and until she shall attain the age of twenty one or marry and do and shall accumulate all the residue thereof (if any) in the way of compound interest by investing the same and all resulting income and produce thereof from time to time in or upon such stocks, funds or securities as are hereinbefore mentioned for the benefit of the person or persons who shall become entitled to the principal fund from which the same shall have proceeded and from and after the said Louisa Tufnell shall attain the age of twenty one years or be married which shall first happen do and shall pay, transfer or assign the said fund so appropriated and set apart together with all accumulations of dividends accrued during her minority (if any) to her, the said Louisa Tufnell, her executors, administrators and assigns for her and their own use and benefit.

And I declare my will and mind to be that in case the said Louisa Tufnell shall die under the age of twenty one years and without being or having been married the said fund so appropriated and set apart shall sink into and again form part of the said last mentioned moiety of the said trust monies, stocks, funds and securities from which the same is hereinbefore directed to be appropriated and set apart as aforesaid and shall follow and be subject to the trusts and dispositions hereinafter declared or contained concerning the residue of the same moiety.

And I hereby further declare my will and mind to be that the said trustees or trustee for the time being do and shall from and after the death of my said wife in case she shall survive me or if she shall die in my life time then from and immediately after my death stand and be possessed of and interested in the residue of the said last mentioned moiety of the said trust monies, stocks, funds and securities (subject to the appropriation hereinbefore directed to be made out of the same moiety as foresaid) upon trust that they the said trustees or trustee for the time being do and shall during the life of my said son, William Bewley Tufnell, (in case and so often and from time to time so long as the same trustees or trustee for the time being shall in their or his free and uncontrolled discretion think proper and not otherwise) pay the dividends, interest and annual produce of the said residue and remainder of such last mentioned moiety or any part of the same dividends, interest and annual produce as and when the same shall become due and payable and be by them received into the proper hands of the said William Bewley Tufnell for his own use and benefit.

But in case the same trustees or trustee for the time being shall in such their or his free and uncontrolled discretion as aforesaid from time to time or at any time think proper and determine not to pay or no longer to pay the said last mentioned dividends, interest and annual produce or any part thereof to the said William Bewley Tufnell then to pay the same or any part thereof (if they or he shall think proper but not otherwise) unto and for the separate use or for the support of the wife and child or children of the said William Bewley Tufnell for the time being or any of them (other than the said Louisa Tufnell) or for the education and instruction or advancement in any profession or business of the same children or any of them (other than the said Louisa Tufnell) in such manner and in such proportions as the same trustees or trustee for the time being shall approve.

And as to any part or parts of the said last mentioned dividends, interest and annual produce which shall from time to time during the life of the said William Bewley Tufnell remain unapplied by the same trustees or trustee for the time being for any of the purposes aforesaid upon trust to lay out and accumulate the same and the yearly produce of the accumulation by investment in any of the parliamentary stocks or public funds of Great Britain or at interest upon government or real securities in England (yet so that the period of accumulation shall in no case extend beyond the period of twenty one years from my death) and to stand possessed of such accumulations upon the same trusts and for the same intents and purposes as are herein declared of the principal fund from which the same shall have proceeded and from and after the death of the said William Bewley Tufnell do and shall in case his present wife, Frances Tufnell, shall be then living pay and apply the dividends, interest and annual produce of the said last mentioned moiety of the said trust monies, stocks, funds and securities (subject as aforesaid) and also the dividends, interest and annual produce of the accumulations thereof to or permit the same to be received by the said Frances Tufnell for her life to be by her applied for the maintenance of herself and the maintenance, support and education of her children by my said son (other than the said Louisa Tufnell).

And from and after the death and survivor of them the William Bewley Tufnell and Frances his wife do and shall stand and be possessed of and interested in the said last mentioned moiety of the said trust monies, stocks, funds and securities (subject as aforesaid) and the dividends, interest and income thereof in trust for all and every the child and children of the said William Bewley Tufnell and by the said Frances, his wife, now born or hereafter to be born who being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry (other than and except the said Louisa Tufnell) to be divided between or among such children if more than one besides the said Louisa Tufnell in equal shares and if there shall be only one besides the said Louisa Tufnell the whole to be in trust for that one provided always.

And I hereby declare my will and mind to be that the said trustees or trustee for the time being do and shall after the death of the survivor of them my said son William Bewley Tufnell and his said wife Frances pay and apply the whole or such part as the said trustees or trustee for the time being shall think fit of the dividends, interest and produce of the portion or respective portions to which any child or children of my said son William Bewley Tufnell by his said wife Frances shall or may be entitled in [illegible] under the trust last hereinbefore declared for or towards the maintenance and education of such child or children in the mean time and until such his, her or their portion or portions shall become payable and do and shall during such suspense of absolute vesting as aforesaid accumulate all the residue thereof (if any) in the way of compound interest by investing the same and all the resulting income and produce thereof from time to time I and upon any such stocks, funds and securities as are hereinbefore mentioned for the person or persons who under the trusts herein remained shall become entitled to the principal fun from which the same respectively shall have proceeded.

And I hereby declare my will and mind to be if there shall be no child of my said son William Bewley Tufnell by his said wife Frances living at my death or born afterwards (other than the said Louisa Tufnell)...in trust for the said Louisa Tufnell...then in trust of my said son John Tufnell...

And I hereby declare my will and mind to be that in case the said Louisa Tufnell shall attain the age of twenty one years or marry and there shall be any other child or children of my said son William Bewley Tufnell by his said wife Frances living at my death or born afterwards...and the share of such other child or each such other child under the trust herein before contained shall exceed the sum of four thousand pounds sterling in value then and in such case so much shall be taken from the share of such other child or from the share of each such other child and added to the fund so appropriated or set apart for the benefit of my said granddaughter, Louisa, as shall make the whole share or portion of the said Louisa equal in value to the share to which any other child of my said son William Bewley Tufnell by his said wife Frances shall become entitled to...

I hereby give and devise all the manors, messuages, lands, tenements and hereditaments and real estate of or to which I or any person or persons in trust for me own, is or are seized or entitled for any estate of freehold or inheritance of freehold only whether in possession, reversion, remainder or expectancy or which I have power to appoint or dispose of by this my will with there and every of there rights, members and appurtenances unto and to the use of my said son John Tufnell his heirs and assigns for ever for his and their own benefit provided always.

And I hereby declare my will and mind to be that the receipt or receipts...and I hereby nominate and appoint my said son John Tufnell and the said William and Edward Leigh Pemberton executors of this my will...

John married Hannah Bewley on 8 Jun 1774 in Kirton, Lincolnshire. Hannah died in 1836.

General Notes: This is the last will and testament of me, Hannah Tufnell, now residing in Henrietta Street, Cavendish Square in the county of Middlesex, widow, I direct that all my just debts and my funeral and testamentary expenses shall be paid and satisfied as soon as conveniently can be after my decease.

I give and bequeath to my eldest son, John Tufnell, of Horkstow Hall in the county of Lincoln, Esq., my ring marked with the letters JJT and to my granddaughter, Julia Tufnell, my yellow diamond ring.

And I give and bequeath the watch, chain, seals and key which belonged to my deceased husband to my grandson, William Tufnell

And I give and bequeath all my silver and other plate and all my linen unto my said eldest son, John Tufnell.

As to one half part thereof as near as may be, to be selected by himself, for his own use and benefit.

And as to the other half thereof to divide and distribute the same amongst such members of the family of my son William Bewley Tufnell and in such proportions and manner as he, my son John Tufnell shall in his sole and uncontrolled discretion think fit.

I give and bequeath to Ann Blyton who has been a faithful servant to me for nearly forty years the sum of three hundred pounds as a recompense for her long services and the great care with which she has attended upon me during my long illness.

I give and bequeath to my nephew Mr Mott Caton the sum of fifty pounds as acknowledgement of the kind attention I have always received fom him and his wife.

And I give to my nephew Mr Richard Caton nineteen guineas with which I request him to buy a ring in remembrance of me.

And I give and bequeath unto my said son, John Tufnell, and Edward Leigh Pemberton of Salisbury Square, London, gentleman, and their executors, administrators and assigns all the rest, residue and remainder of all my money, money in the funds, goods, chattels and personal estate and effects whatsoever and wheresoever not hereinbefore specifically bequeathed or otherwise disposed of upon trust that they the said John Tufnell, and Edward Leigh Pemberton or the survivor of them or the executors, administrators or assigns of such survivor do and shall as soon as conveniently may be after my decease collect, get in and receive all such money as shall then be due to me from any person or persons and do and shall sell and dispose of and convert into money such part of my said residuary personal estate as shall not consist of money or money in the funds and do and shall by and out of that part of my personal estate which shall consist of money and the money to be collected and received as aforesaid and the produce of ant stocks or funds belonging to me (which my said trustees or trustee are and is hereby authorised and empowered at any time to sell and dispose of) pay and discharge all my just debts and funeral and testamentary expenses and the legacies hereinbefore bequeathed and do and shall lay out and invest the then residue of the said trust monies in or upon any of the stocks or funds of Great Britain or upon real securities in England or Wales  and do and shall vary and change the said stocks, funds and securities from time to time either as occasion shall require as they or he my said trustees or trustee for the time being shall think fit and do and shall stand and be possessed of all and singular the said trust monies, stocks, funds and securities and of the stocks and funds belonging to me at my death or such part of the same as shall not be applied for the purposes aforesaid and the dividends, interest and income thereof respectively upon the trust and for the intents and purposes hereinafter expressed and declared concerning the same (that is to say):

As to and concerning one equal moiety of half part of the same residuary trust monies, stocks, funds and securities upon trust for my said son, John Tufnell, his executors, administrators and assigns absolutely for his and their own benefit.

And as to and concerning the other or remaining moiety or half part of the same residuary trust monies, stocks, funds and securities upon trust in the first place to raise and pay thereout or therefrom the sum of one hundred pounds to Frances the wife of my second son, William Bewley Tufnell, for her own separate use independently of her husband and so as not to be under his control or subject or liable to his debts or engagements and for which her receipt alone notwithstanding her coverture shall be good discharge.

And as to and concerning the residue of such last mentioned moiety of the said residuary trust monies, stocks, funds and securities after payment of the said sum of one hundred pounds to the said Frances Tufnell as aforesaid (and which sum I direct shall be paid accordingly within six calendar months after my decease) upon trust for all and every my grandchildren born and to be born the sons and daughters of my said second son, William Bewley Tufnell, by his present wife or such of them as shall be living at the time of my decease and who shall attain the age of twenty one years to be equally divided between them...

And I do hereby declare that the receipts in writing of the trustees...

And I appoint the said son, John Tufnell, and Edward Leigh Pemberton executors of this my will.

And lastly I do hereby revoke...19 July 1834.

13.  Richard Tufnell (John Jolliffe 3, Samuel 2, John 1) was born after 1753 and was buried on 26 Feb 1826 in Pleshey, Essex. He had no known marriage and no known children.

General Notes: This is the last will and testament of me, Richard Tufnell, of Great Waltham in the county of Essex, esquire.

First I direct that all my just debts, funeral and testamentary expenses shall be paid with all convenient speed after my decease out of my personal estate.

I give and devise unto my niece Ann Tufnell, of Chelmsford in the county of Essex, spinster, her heirs and assigns all that the messuage or tenement and dwelling house situate in Great Waltham aforesaid now in my own occupation and also the messuage or tenement adjoining and all the lands, grounds, outhouses, gardens and appurtenances to the said messuages or tenements respectively belonging or in any wise appertaining or therewith used, occupied or enjoyed to hold the same messuages or tenements, lands, hereditaments and premises unto and to the only proper us and benefit of my said niece, Anna Tufnell, her heirs and assigns for ever.

I also give and bequeath unto my said niece all the household goods and furniture, plate, linen, china, books, pictures, prints, carriages, horses, cattle and other effects which I shall be possessed of at the time of my decease (ready money, stocks, funds and other securities for money only excepted).

I also give and bequeath unto my said niece so much and such part or parts of my capital stock in the three per cent consolidated bank annuities or other public funds as shall by the annual dividends or interest thereof produce at the time of my decease the annual sum of one thousand pounds sterling to and for her own absolute use and benefit.

I give and devise to my nephew the Rev George Tufnell his heirs and assigns all and every my freehold and copyhold messuages or tenements, lands, hereditaments and premises situate in Great Waltham aforesaid not hereinbefore devised to my said niece to hold the same with the appurtenances unto and to the only proper use and benefit of my said nephew, George Tufnell, his heirs and assigns for ever.

I give and bequeath unto my maid servant Elizabeth Potter the sum of two hundred pounds of lawful English money and to each of the other man servants and maid servants which shall be living with me at the time of my decease the sum of one hundred of like lawful money.

And my will is that the several legacies hereby bequeathed shall be paid or retained by my executors hereinafter named at the end of three calendar months next after my decease free from all deductions on account of legacy duty and that the legacy duty payable in respect of the said legacies respectively shall be paid by my executors out of my personal estate.

And as to all the rest, residue and remainder of my monies, stocks, funds, securities and other my personal estate not hereinbefore specifically bequeathed (after and subject to the payment of my debts, legacies and legacy duty and funeral and testamentary expenses) I give and bequeath the same and every part thereof unto my brother John Tufnell to and for his own absolute use and benefit.

And I nominate and appoint my said brother John Tufnell sole executor of this my will and testament and do hereby revoke...

In witness whereof...07 Sept 1825 the mark of X Richard Tufnell.

I, the abovenamed Richard Tufnell, do by this a codicil to my above written will give and bequeath unto Sarah the wife of George Gosling, late Sarah Milner, spinster, who lived with me many years, the sum of five hundred pounds to be paid to her at the same time and free of all deductions for legacy duty as the legacies bequeathed by my will and directed to be paid X the mark of Richard Tufnell.

Proved at London 15 Apr 1826.

14. William Tufnell (George 3, Samuel 2, John 1) was baptised on 4 May 1769 and died on 26 Apr 1809, aged 39.

Biography

Tufnell's grandfather, Samuel Tufnell of Langleys, Essex, sat for Colchester 1727-34 and his father and uncle represented Beverley in turn: in fact, according to the family historian, 'since 1640 every generation, with one exception, has produced its Members of Parliament'. William Tufnell was called to the bar, but appeared in the law lists only briefly, at 6 Grays Inn Square. In 1802 he made inquiries about a possible opening at Lewes, where he had practised at sessions, but not necessarily for himself: he seems rather to have contemplated standing for Colchester, but demurred because he had left it too late. In 1806 he stood for Colchester as a friend of the Grenville administration: when the Prince of Wales tried to promote the candidature of another man, Thomas Creevey, by his own account, thwarted it by letting the Prince have 'a bill of fare of Tuffy's merits and pretensions'.

All Tufnell's family were employed in securing his success, after which he proceeded to Brentford to propose Byng for Middlesex. He was listed as a staunch supporter of the abolition of the slave trade. He supported ministers to the end, defending Brand's motion against the King's replacement of them, 9 Apr. 1807, on the grounds that it would discourage the allies and raise the hopes of the enemy, besides which 'ministers appointed by the crown should possess the confidence of both the aristocracy and the democracy of the country', which the new administration did not, owing its appointment to a dangerous use of the royal prerogative. Only one other speech of his is known, 18 Mar. 1807: he attempted, unsuccessfully, to secure the recommittal of the forfeited estates bill.

Tufnell did not come forward at Colchester in 1807, being replaced by his younger brother Col. John Charles Tufnell. The latter was heavily defeated and the victim of a 'No Popery' cry. William Tufnell died 'of a complaint in his bowels', 26 Apr. 1809, aged 40. His son Henry was a prominent Member of Parliament later.

Research Notes: I, William Tufnell, of Cavendish Square declare this to be my last will and testament.

In the first place I direct that I shall be buried in my own vault in Islington church if I should die at any place within one hundred miles of London but if I should die at any greater distance then at the discretion of my executors where they shall judge most convenient.

I direct that all my just debts and funeral expenses shall be paid in the first instance and as to the residue of my personal property consisting of money in the hands of my bankers, money in the public funds, on private security or owing to me from any person or on any account whatsoever I give to my mother the sum of three hundred pounds, to my brother, John Charles Tufnell the sum of two hundred pounds and I give one hundred pounds to my mother to be distributed by her in charity to such poor persons within the limits of the city of Chichester as and the Rev William Walker shall judge most worthy of receiving it, the remainder of such my personal property I give to my wife Mary Tufnell.

I specifically bequeath and give to my said wife in the first instance all the jewels and pearls which she has in her own possession, the sapphire ring only excepted which belonged to Sir William Halton and which I give and leave as an heir loom to my brother John Charles Tufnell.

I give to my excellent wife all my plate, the large silver waiter which belonged to Sir William Halton only excepted which I also devise by way of an heir loom to my said brother John Charles Tufnell.

I give to my wife all the furniture of my house, my carriages, horses, harness etc.

As a specific bequest I give and devise all my copyhold property at Islington held under the manor of Canbury, otherwise Cannonbury, which I have surrendered to the use of my will and of which I have suffered a recovery in the lords court of the said manor to Thomas Creevey, Esq., Mr John and William Brereton of Payham in the county of Sussex, esquires, and the survivor of them and the executors of such survivor in trust to pay to my wife, Mary Tufnell, the sum of three hundred pounds a year secured to her by her marriage settlement [illegible] for and during her natural life and from and after her decease or other sooner determination of the said estate then to the use of any son or sons, daughter or daughters whom I may leave to be applied in their maintenance and education at the discretion of my brother, John Charles Tufnell, and my mother Mary Tufnell whom I hereby appoint guardians of any such child or children after the decease of my wife May Tufnell  until such time as my eldest son shall attain the age of twenty five years then to him and his heirs for ever.

And upon this further trust to pay the remainder of such my copyhold estate after paying the said five [sic] hundred pounds a year and also paying the expense of collecting the several rents to my dear mother, Mary Tufnell, for and during the term of her natural life and from and after her decease then to my friends Thomas Creevey and William Brereton, esquire, and the survivor of them and the executors of such survivor in trust to pay and apply the said remainder in the maintenance and education of any chid or children whom I may leave.

And I further direct that such sum so provided for the maintenance of such my child or children shall be paid to my dear wife Mary Tufnell to be applied by her in such maintenance and education and I do hereby appoint her sole guardian of such child or children until they shall arrive at the age of 21 years or if a daughter or daughters shall marry with the consent and approbation of her said mother and guardian and when and so soon as my said son shall attain the age of twenty one years or if a daughter shall be married with such consent and approbation as aforesaid but not otherwise then to the use of such son or sons, daughter or daughters to be equally divided between them share and share alike and to hold as tenants in common and in case of default of issue of my own or in case they shall all die before they attain respectively their age of 21 years or day of marriage then to my dear brother, John Charles Tufnell, and his heirs for ever.

As to my manor of Barnsbury in the county of Middlesex together with the farm belonging thereto now in the occupation of Mr Graves and charged with the payment of three hundred pounds a year to my wife I give and devise the said manor together with all the rights, fines and appurtenances thereto belonging and appertaining together with the farm at Holloway so charged as aforesaid unto Thomas Creevey, esquire, and William Brereton, esquire, and the survivor of them and the executors and administrators of such survivor in trust to pay and apply the rent, issues and profits thereof to my dear wife, Mary Tufnell, until such time as my eldest son shall attain the age of twenty five years and then to him such son for and during the term of his natural life and from and after his decease...

And in case...to the use of my brother, John Charles Tufnell, and his heirs for ever and in case...to the use of my dear wife... to the use of John Charles Tufnell... to the use of William Tufnell, second son of my brother, John Charles Tufnell, for and during...

I give to my brother, John Charles Tufnell, all such monies as he shall stand indebted to me at the time of my decease of what nature or kind soever.

I further give to my said brother, John Charles Tufnell, my freehold house in King Street, Cheapside now let to Mrs Taylor as an ironmonger's shop.

And I give to my said trustees, Thomas Creevey and William Brereton, esquire, one hundred pounds each.

And I appoint my wife, Mary Tufnell, and my brother, John Charles Tufnell, joint executors of this my will.

General Notes: This is the last will and testament of me, Mary Tufnell, of Cavendish Square in the county of Middlesex, widow, I direct all my just debts to be paid.

I give to my second son, Edward Carleton Tufnell, two thousand pounds also my tea service of green and gold [illegible], devoire of blue and white, Nankin china, my silver teapot and [illegible] ewer to match, twelve silver tea spoons, fish slice dolphin engraved and four silver salt cellars with spoons.

All the residue of my estate and effects I give to my eldest son Henry Tufnell and I appoint him my sole executor.

General Notes: I, John Charles Tufnell, of Bath in the county of Somerset, banker, do declare this to be my last will and testament.

I leave the place and manner of my interment to my dear wife Uliana Margaret Tufnell but wish it to be as private and attended with as little expense as possible.

I give my household and other furniture, jewels, plate, linen, books, pictures, wines and other liquors, china and glass unto my said wife for her own use and benefit.

I give and devise all and singular the messuages, lands, tenements, hereditaments and estates and effects whatsoever and wheresoever which I am entitled to, interested in or have power to dispose of in reversion or remainder or upon and contingency or otherwise under or by virtue of the will of my late brother, William Tufnell, deceased, unto and to the use of my said wife and my sons Thomas Jolliffe Tufnell and Thomas Robert Tufnell their heirs, executors, administrators and assigns aforesaid to the nature of the same estates respectively upon the trusts and with, under and subject to the powers and provisos hereinafter declared and contained concerning the same (that is to say):

In trust that they my said trustees or the survivor of them or the heirs, executors or administrators of such survivor shall be in the actual possession or entitled to receive the rents, issues and profits of the same estates or any of them or any part thereof or so soon afterwards as conveniently may be but not sooner make sale and dispose of the same estates or such of them or such parts thereof as shall have so come into possession or to the receipt of the rents and profits whereof my said trustees or trustee shall have so become entitled as aforesaid either altogether or in lots and either at one time or at several times and either by public auction or by private contract to any person or persons who shall be willing to purchase the same or any part thereof for the best price or price that can reasonably be obtained for the same and do and shall convey and assure the same premises unto and to the use of...

And I declare that it shall be lawful for my trustees or trustee for the time being...and after satisfaction thereof in trust to pay and divide the residue of such monies unto and amongst all such of my children living at my decease as shall have attained or shall thereafter attain the age of twenty one years in equal shares and proportion as tenants in common...

And I declare that if my children shall die in my lifetime leaving lawful issue living at my death or any of my children who shall be living at my decease shall afterwards die under the age of twenty one years leaving lawful issue at his, her or their death or respective deaths then in either and every of such cases the share which each such child or each of such children so dying as aforesaid would have been entitled to by virtue of this my will of or in the trust monies aforesaid in case he or she had attained the age of twenty on years...shall be held in trust for an only child or each such child if there shall be but one such grandchild...or if there should be two or more such grandchildren then in trust for all such of them as shall attain the age of twenty one years in equal shares as tenants in common...

And I declare that the real estate hereinbefore made saleable shall for the purposes of this my will be considered as converted into personality immediately upon my decease and shall be disposable and distributable accordingly and that the rents and profits of the same premises after the same shall have become saleable as aforesaid and until sale thereof shall be payable and applicable in like manner...

And I direct that such part of any of the monies to arise under the trusts aforesaid as shall not for the time being be absolutely vested in and payable...shall be invested in the purchase of three pounds per cent reduced bank annuities in trust for the person or persons interested in the same monies by virtue of this my will provided always.

And I declare that it shall be lawful for the trustees or trustee for the time being...to apply...towards the maintenance and education of such child or children, grandchild or grandchildren as aforesaid...

And I direct the surplus, if any...be invested in the purchase of three pounds per cent reduced bank annuities in trust to be held in trust as aforesaid...

And I further declare that it shall be lawful for the trustees or trustee for the time being...to which any son or sons of my body or grandson or grandsons as aforesaid shall be presumptively entitled to and in the same trust premises for the preferment or advancement in the world of any such son or sons of my body or grandson or grandsons during his or their respective minority anything hereinbefore contained to the contrary notwithstanding.

And I give, devise and bequeath all the rest, remainder and residue of my real and personal estate and effects whatsoever and wheresoever including all such estates and effects as I have any power to appoint and dispose of upon the trusts and purposes hereinafter declared to the use of my wife and my said sons, Thomas Jolliffe Tufnell and Thomas Robert Tufnell their heirs, executors, administrators and assigns according to the same estates respectively upon trust...shall convert such part as shall not consist of money or securities for money into money in the same or like manner...and do and shall call in all monies due to me on any security or securities or otherwise and do and shall...pay the expenses incident to the sale and conversion and getting in...and all my just debts and funeral expenses and the charges of proving this my will and do and shall lay out and invest the residue... in the purchase of three pounds per cent reduced bank annuities upon the trusts following (that is to say):

To pay the interest...unto my said wife and her assigns for and during her natural life...and in the meantime for the benefit of all my children living at my decease and their issue (if any) of those that may die in my lifetime...and for the benefit of any grandchild's, that may die in my lifetime, issue...

And I declare it shall be lawful...to rent out any of the premises before their sale...

And I hereby nominate and appoint my said dear wife and my said sons, Thomas Jolliffe Tufnell and Thomas Robert Tufnell executors of this my will and testament and I appoint my said wife, and in case of her death my said sons, Thomas Jolliffe Tufnell and Thomas Robert Tufnell guardians...of such of my children as shall be minors at my decease...

General Notes: This is the last will and testament of me, Uliana Margaret Tufnell, widow of Colonel John Charles Tufnell, of the city of Bath, deceased.

Whereas by virtue of an indenture of release bearing date the twenty second day of April 1796 being the settlement made previously to and in contemplation of my marriage with the said John Charles Tufnell a certain farm, lands and hereditaments called [illegible] Farm situate at Hornchurch in the county of Essex were, with other hereditaments conveyed and assured unto Charles Shuttleworth and George White Thomas, esquires, and Sir Edward [illegible], baronet, their heirs and assigns upon trust to sell and dispose of the same as soon as I, the said Uliana Margaret Tufnell, then Uliana Margaret Fowell, spinster, should attain the age of twenty one years and to invest the monies to arise therefrom in some or one of the parliamentary stocks or funds of Great Britain or upon real securities in their joint names and to pay the interest and dividends after the death of my father, the Rev John Fowell DD to me, the said Uliana Margaret Tufnell, for life and after my decease to pay, transfer and assign the said stocks, funds and securities and the interest and dividends thereof unto and amongst all and every the child and children of my said then intended marriage in such manner, shares and proportions as I, the said Uliana Margaret Tufnell, will alone should by any deed or instructed in writing or by my last will and testament...instruct or appoint, give or bequeath the same and in default thereof upon certain other trusts therein executed.

And whereas the said farm, lands and hereditaments were sold and disposed of by the said trustees and invested in five thousand four hundred and fifty two pounds eighteen shillings and three pence three pounds per cent consolidated bank annuities and whereas by an indenture of appointment bearing date 12 Feb 1819 the sum of three thousand pounds was appointed by me, subject to my life interest and that of my husband therein unto my daughter, Mary Jane, the wife of Edward Jennings, esquire, for her absolute benefit and whereas my late father by his last will and testament left the residue of his personal estate to me to take for my own uses upon trust to sell such parts as should not consist of money or securities and to invest the monies arising and to have the interest and dividends for life for my separate use and exclusive benefit and disposal and on my decease in trust for my children or grandchildren and whereas part of that estate consisted of £7500 of three and a half per cent consolidated bank annuities which is now standing in my father's name except so much as was taken by me according to his will which has been sold and reinvested in my name in £8925,18.10 bank annuities now I, the said Uliana Margaret Tufnell, give and bequeath the sum of eighteen shillings and three pence bank annuities, part thereof equally between my four children, John Charles Fowell Tufnell, Thomas Jolliffe Tufnell, Thomas Robert Tufnell and Frances, the wife of the Rev Robert Young Keays, Clerk, and the sum of £2450 consolidated bank annuities being the residue of the £5452.18.3 of like annuities after the aforesaid deductions unto my son Edward Wyndham Tufnell who is the only other of my children not hereinbefore mentioned.

And I do hereby direct, bequeath and appoint the sum of £317.4.8 bank annuities part of the £8624.18.10 [sic] and the sum of £1545.16.00 bank annuities part of the £7500 of like annuities to my said son, Edward Wyndham Tufnell, for his absolute benefit

And the sum of £2769.4.8 bank annuities and the sum of £1545.16.0 like annuities to my said son, Thomas Jolliffe Tufnell, for his own absolute benefit.

And the sum of £2769.4.8 to my said son, Thomas Robert Tufnell, for his own absolute benefit.

And the sum of £1316.16.00 to my said son, John Charles Fowell Tufnell, for his own absolute benefit.

And I do hereby declare that my said son, John Charles Fowell Tufnell, shall stand possessed of and interested in the said sum of £1316.16.00 upon trust during the life of my said daughter, Mary Jane Jennings, to pay the dividends unto her for her own separate use and she shall have no power over the principal sum and after her decease to her children as tenants in common.

And I do hereby declare it shall be lawful for my said son, John Charles Fowell Tufnell, to pay the dividends after my said daughters decease towards the maintenance and education, preferment and advancement or establishment in life of her children and to vary the investments.

And I do hereby declare my said son, John Charles Fowell Tufnell, shall stand possessed in the principal sums of £2769 and £1545.16.00 for the benefit of my said daughter, Frances Keays, and her children etc...

And I appoint my said son, John Charles Fowell Tufnell, my sole executor...

And lastly I revoke...in testimony whereof...09 Dec 1846.

This is a codicil to the last will and testament... I give and bequeath all my furniture, plate, linen, china, books and my collection of fossils and minerals and all the residue of my personal estate and effects unto my son John Charles Fowell Tufnell...whom I have nominated and appointed to be trustee and executor of my said will upon trust in the first place for payment of all my just debts and funeral and testamentary expenses and after such payment and satisfaction thereof and subject thereto I give and bequeath unto my daughter Mary Jane Jennings all my wearing apparel of every sort and description, to my son the said, John Charles Fowell Tufnell, the [illegible] paper case and my father's picture, to my son, Thomas Robert Tufnell, the davenport which formerly belonged to my late son Bonham.

And I also give and bequeath to the several persons mentioned in a paper writing which will be found in my trinket box the several articles and therein described as remembrances.

And I direct the residue of my estate and effects except as aforesaid should be divided equally between my children...29 Dec 1846.

General Notes: He was educated at Rugby, and on 27th June, 1796, was made a Fellow-Commoner of Trinity College, Cambridge, but neither matriculated nor graduated.  He was J.P. and D.L. for Essex, and in 1823 was High Sheriff for the county.

John Jolliffe Tufnell had four sons and six daughters.

Jolliffe 3, Samuel 2, John 1) was born 
in 1775 and died on 18 Mar 1838 in 
Horkstow, Lincolnshire, aged 63.

General Notes: This is the last will and 
testament of me, John Tufnell, of 
Horkstow Hall in the county of Lincoln, 
esquire, I direct that all my just debts 
and my funeral and testamentary 
expenses shall be paid and satisfied as 
soon as conveniently can be after my 
decease.

I give and bequeath to my wife Anne 
Tufnell all the implements of husbandry, 
growing crops of corn and grain and every 
other description, cattle and live and 
dead stock of every sort and description, 
household goods and furniture, plate 
(except such articles of plate as I shall 
otherwise dispose of by any codicil or 
writing under my hand), linen, wearing 
apparel, jewels, trinkets, china, books, 
pictures, horses, carriages, wines and 
other liquors, provisions and provender 
whatsoever of which I shall be possessed 
and all my ready money as well in my 
house as at my bankers at the time of my 
decease to and for her own use and benefit.

And I give and bequeath to my cousin, the Rev William Tufnell, of East Bergholt in the county of Suffolk the sum of one hundred pounds to be paid within six months after my decease.

And I give and bequeath to Edward Leigh Pemberton of Salisbury Square, London, esquire, the like sum of one hundred pounds.

And I give and devise and by virtue and in exercise or every power enabling me in this behalf appoint all my manors, messuages, lands, tenements & hereditaments whatsoever as well freehold and copyhold situate, lying and being in the counties of Lincoln and Essex or elsewhere of or to which I or any person or persons in trust for me is or are possessed or entitled either in possession, reversion, remainder or expectancy or for any other devisable estate or interest or over which I have any power of disposition with their and every of their rights, members and appurts except such estates as are vested in me upon any trusts or by way of mortgage unto my said cousin, William Tufnell, and the said Edward Leigh Pemberton their heirs and assigns upon trust that they my said trustees or the survivors or survivor of them and his, her or their heirs and assigns do and shall as soon as conveniently can be after my decease absolutely sell and dispose of the same and every part thereof either by public auction or private contract as he or they shall think fit and do and shall convey and assure the same when sold unto the purchaser thereof, his, her or their heirs and assigns or as he, she or they shall direct but I declare my will is it to be that the said Anne my wife if she shall survive me shall at any time during the period of six calendar months from the day of my decease have the option of becoming the purchaser of the lands and heredits which I purchased of Mr Nicholson and which were part of a certain estate called the North Grange Estate situate in Horkstow in the county of Lincoln at or for the price of or sum of four thousand five hundred pounds and that in the event of my said wife becoming such purchaser my said trustees or trustee for the time being shall or may if they think fit give such time or make such security for the payment of the said sum of four thousand five hundred pounds purchase money or any part thereof with interest in the mean time at four pounds per cent per annum or at any rate as they or he shall think proper.

And I also hereby declare that the receipts...

And I further declare that the money which shall arise by or from all and every or any such sale or sales as aforesaid shall be considered as part of the residue of my personal estate and that the rents and profits of the said heredits and premises in the mean time till such sale shall be considered as part of the residue of my personal estate or of the securities on which the same is hereinafter directed to be invested and that the same monies, rents and profits respectively shall be subject to the trusts and dispositions hereinafter declared and contained concerning my said residuary personal estate and the income thereof.

And I give and bequeath unto my said cousin, William Tufnell, and the said Edward Leigh Pemberton their executors, administrators and assigns all the rest, residue and remainder of my money and securities for money, money in the funds, goods, chattels and personal estate and effects whatsoever and  wheresoever not hereinbefore specifically bequeathed or otherwise disposed of upon trust that they my said trustees or the survivors or survivor of them or the executors, administrators or assigns of such survivor do and shall as soon as conveniently can be after my decease collect, get in and receive such money as shall then be due to me from any person or persons and do and shall sell and dispose of and convert into money such parts of my said residuary personal estate as shall not consist of money or money in the funds and do and shall by and out of that part of my said residuary personal estate which shall consist of money and the money to be collected and received as aforesaid and the produce of any stocks or funds belonging to me (which my said trustees or trustee are and is hereby authorised and empowered at any time to dispose of) pay and discharge all my just debts and funeral and testamentary expenses and the legacies hereinbefore bequeathed and do and shall lay out and invest the then residue of the said trust monies and the monies which shall arise from the sales of my said real estates as aforesaid in or upon any of the stocks or funds of Great Britain or upon real securities in England or Wales and do and shall vary and change the said stocks, funds and securities from time to time either as occasion  shall require or as they or he my said trustees or trustee for the time being shall think fit and do and shall stand and be possessed of all and singular the said trust monies, stocks, funds and securities and of the stocks and funds belonging to me at my death or such part of the same as shall not be applied for the purposes aforesaid and the dividends, interest and income thereof respectively upon the trusts hereinafter expressed and declared of and concerning the same viz:

Upon trust for all and every the children of my brother William Bewley Tufnell who shall be living at or born after my decease previously [?] to any one of the children being a son attaining the age of twenty five years or being a daughter attaining that age or being married with such consent as hereinafter mentioned to be equally divided between the same children if more than one...and in case there shall be no child of my said brother who shall live to attain a vested interest in the said trust monies... then to my said cousin, William Tufnell...then to his daughter Katherine Ann Tufnell..then to the children of John Jolliffe Tufnell of Langleys in Great Waltham...then to the person or persons...who shall be of my blood and in kin to me...

And I declare my will and mind is it shall be lawful to and for my trustees...to apply the income to my brother's children's maintenance, schooling, clothing or advancement...

And I give and bequeath to my said trustees all such real estates as are vested in me...and I appoint them executors of this my will...

And lastly I do hereby revoke...in witness whereof...24 July 1829.

I republish my will for the purpose of passing thereby the estate I have bought of Mr [illegible] and the purchase of which has been completed this day 29 Jan 1830.

By this codicil to the foregoing will I give and bequeath a legacy of one hundred and fifty pounds sterling to my late servant Charlotte Ashton now residing at Saxby in the county of Lincoln and I direct the same to be paid to her within six calendar months next after my decease without deduction for legacy duty and in all other respects I confirm and now do republish my said will...23 July 1830.

This is a codicil to the last will and testament of me, John Tufnell, of Horkstow in the county of Lincoln, esquire, which I desire and direct may be annexed to and taken as part thereof, whereas I have in and by my last will and testament given, devised and bequeathed my several real and personal estates as therein particularly mentioned and contained now I do hereby give and bequeath unto Charles Coote, son of Hannah Coote late of Great Waltham in the county of Essex, who was an apprentice to Mr Westley of Great Waltham aforesaid, baker, the sum of three hundred pounds sterling to and for his own use and benefit absolutely by the executor in my said will named and appointed at the expiration of twelve calendar months next after my decease without interest for the same in the mean time but free of all charges or deductions for legacy duty or otherwise and in case of his death...leaving lawful issue then to his child or children...

I hereby ratify and confirm my said will...10 July 1837.

This is a codicil to the last will and testament of me, John Tufnell, of Horkstow in the county of Lincoln, esquire, which I desire and direct may be annexed to and taken as part thereof, whereas I have in and by my last will and testament dated...my real and personal estates...and by an agreement dated 11 Jan 1838 between Robert Brown of Barton upon Humber and William Everett Hobson of Kettleby Thorpe and myself I have agreed to purchase the manors of Barrow and Barton for twenty two thousand pounds to completed by on the 13 May 1838...I do hereby give and bequeath the same to my trustees as aforesaid...21 Feb 1838.

Proved at London 10 May 1838.

28.  William Bewley Tufnell (John 4, John Jolliffe 3, Samuel 2, John 1) was born in 1784 and died on 14 May 1867 in New York, USA, aged 83.

William married Frances Milner on 18 Jul 1807. Frances was born in 1786.  Another name for Frances was Frances Wilson.

29.  Henry Tufnell (William 4, George 3, Samuel 2, John 1) was born on 10 Nov 1805 in Chichester, West Sussex and died on 15 Jun 1854, aged 48.

General Notes: He was the eldest son of William Tufnell of Chichester (MP for Colchester, 1806) and was educated at Eton College and Christ Church, Oxford, where he graduated B.A. in 1829. Whilst at Oxford, he, along with George Cornewall Lewis, translated Karl Otfried Müller's book The History and Antiquities of the Doric Race into English.

He was appointed secretary to Sir Robert Wilmot-Horton when the latter was Governor of Ceylon and from 1835 to 1839 was Private Secretary to Lord Minto when that Earl was First Lord of the Admiralty.

He entered the House of Commons in 1837 as a member for Ipswich, having previously been defeated in the Colchester election in 1835, but lost that seat a year later. He was returned for Devonport in a by-election in 1840 and held that seat until 1854. He held minor posts in the governments of Lord Melbourne and Lord John Russell, and was made a Privy Counsellor when he resigned for health reasons in 1850.

He was educated at Eton and Oxford, and took his B.A, in 1825.3 He entered as a student at Lincoln's Inn in 1827, and about this time collaborated with Sir George Cornewall Lewis in a translation of Muller's Histories and Antiquities of the Doric Race.

He married his first wife, Anne Augusta Wilmot-Horton, in 1830, and the following year embarked on his political career, accompanying his father-in-law, Sir Robert John Wilmot-Horton, Governor of Ceylon, to that island as his private secretary. He had returned by the close of 1834, for he was then canvassing (unsuccessfully as it turned out) Colchester in the Liberal interest.

A letter from him to his brother at this date is interesting, because of the time at which it was written ; he speaks of being late in coming forward and a Liberal, but, nevertheless, "two things very much operate in my favour, first, the remembrance of my father, which is still cherished with the utmost regard, so much so that it has descended to the sons of those who supported him, and, secondly, the very general disposition evinced to have one gentleman upon the Liberal interest."

In 1837 he was returned for Ipswich, but was unseated on petition in 1838. Finally, on 24th June, 1840, he was returned for Devonport, and continued to represent that borough to within a few months of his death. He was also at one time chief Liberal Whip. He was one of the Lords of the Treasury from 1835 to 1840, and in 1846 was made Secretary to the Treasury. In 1848 he took a commission as Captain of a company of the Royal West Middlesex Militia, and was Deputy-Lieutenant for Middlesex in 1849.

His first wife died in 1843, and 1844 he married Frances, second daughter of Sir John Byng, first Earl of Strafford. She died in 1846, and in 1848 he took a third wife, Lady Anne Primrose, eldest daughter of the Earl of Rosebery. Henry Tufnell died in 1854 and his wife in 1862.

Henry Tufnell during his lifetime was brought into personal contact with the leading political men of his day, and many letters written to him, including some from Gladstone and Lord John Russell, have been preserved. There is one letter, however, written to his mother by himself at the age of seven, which we cannot resist quoting. It took ten days to write. Here it is:

"Tolethorpe,

"January 27, 1812.

"My dear Mama,

"I hope you are well. I shall be much obliged to you to allow me to have a pair of black Gaiters, Boots, Waistcoats, and a Scarlet Coat, also a pair of Spurs, a Chesnut colored Poney, a hunting Horn, two Saddles and Bridles, and another Poney of a bay colour.

"Pray Mama let George or some other careful Person you think proper ride one Poney and lead the other to Tolethorpe. " Pray give my Love to my Brother and Sister.

"I am my dear Mama,

"Your affectionate Son,

"Henry Tufnell.

"P.S'.—Pray Mama let my Boots be made by Mr. Hoby. I was at Uffington Wood one day last Month on the Donkey and almost all were in Scarlet excepting me.—Feb. 9."

Research Notes: I, Henry Tufnell, of Curzon Street, Mayfair in the county of Middlesex, esquire, do hereby revoke all wills, codicils and other testamentary dispositions by me at any time or times here before and declare this to be my last will and testament.

As declared by two several indentures of settlement dated 29 May 1845 executed previous to my marriage with Lady Anne Primrose charged my freehold house, 13 Cavendish Square, and the coach house and stable in the mews behind it with divers freehold messuages, land and hereditaments in Dublin and all my reversion in fee simple expectant on the decease of Samuel Richard Liddell of divers lands in the counties of Lincoln and Cumberland and my estate of inheritance of three separate quarter parts of divers freehold lands in the counties of Cumberland and York with the payment to my said wife of an annuity of £1200 to be in bar of dower by two half yearly payments after my decease and by another indenture it was agreed that in the event of my decease before Samuel Richard Liddell then the said sum can be charged on my moiety of the estate of Barnesbury in Islington and although the three indentures were recently destroyed by fire I, by this will confirm their contents.

And whereas I have issue by my late wife, Anna Augusta Wilmot Tufnell, one daughter Augusta Theresa Tufnell now of the age of ---___ years and by late wife, the Hon Frances Tufnell one daughter Caroline Mary Tufnell of the age of ___ years and no other child and my said younger daughter will be entitled to a considerable fortune under the settlement executed on my marriage ith the Hon Frances Tufnell and ample provision is thereby made for her maintenance, education and advancement and whereas I have no issue by my present wife now therefore I give and devise to George Cornwall Lewis and Herbert Wilmot-Horton all my messuages, lands, tenements, hereditaments and real estate in the counties of Lincoln, Cumberland, York and Middlesex in trust to pay the rents, issues and annual profits unto the proper hands of my wife to continue even if she remarries and after her death to my daughter Caroline May Tufnell and then for her children and then their children and if she doesn't have children to Augusta Theresa Tufnell etc...

And as to 13 Cavendish Square and the Dublin and Islington estates to Augusta Theresa Tufnell during her life then to her children and failing such to Caroline May Tufnell and then for her children and failing such issue to his brother Edward Carleton Tufnell.

And if they should both die unmarried under the age of twenty one then the estates shall revert to my residual estate.

I give to my said dear wife all her linen, clothes, wearing apparel, jewels, trinkets, and other articles included in her paraphernalia for her own absolute use and benefit.

I give and bequeath unto my brother the sum of five hundred pounds to be paid within three months after my decease and to be free of legacy duty.

I give and bequeath unto my executor hereinafter named all my household goods and furniture, plate, linen, china, books, pictures, prints, watches, trinkets and jewels of which I may possessed at the time of my decease and not otherwise bequeathed by this my will or any codicil or codicils thereto upon trust to permit the same to be used and enjoyed by my said wife during her life and after her decease I direct that the same shall fall into my residuary personal estate and be considered as part thereof.

And I hereby declare that two schedules or inventories shall be made of the said household goods and furniture and other articles so bequeathed by me as last aforesaid and one of such schedules or inventories shall be signed by said wife and be kept by my said executor and the other of them shall be signed by my said executor and delivered to my said wife.

And as to all my ready money, monies at the bankers, monies in the stocks or funds, securities for money, goods, chattels and all other the personal estate and effects of what nature or kind soever of or to which I may be possessed or entitled to at the time of my decease I give and bequeath the same after payment and satisfaction of all my just debts, funeral and testamentary expenses and the specific and pecuniary legacies given by this my will or which I shall give by any codicil or codicils thereto unto my eldest daughter the said Augusta Theresa Tufnell absolutely.

And I appoint my wife and brother guardians of my daughter Augusta Theresa Tufnell and nominate and appoint my wife, Charles Ramsden and the Hon George Stevens Byng, Viscount Enfield, guardians of my daughter Caroline Mary Tufnell.

I do hereby nominate and appoint the said Edward Carleton Tufnell sole executor of this my last will and testament...

In witness whereof...30 Apr 1849.

I...late of Curzon Street but now of 10 Stanhope Street do declare this to be a codicil to my last will and testament whereas I am desirous of appointing Edward Carleton Tufnell a trustee and making further provision for my said wife and other alterations to my said will as are hereinafter mentioned I hereby revoke the devises and bequests made in my said will to my said trustees and transfer the same to my said brother and the said trustees as aforesaid.

And in addition to the provisions made to my wife now give her first call on the estate I gave to Augusta Theresa now the wife of the Rev Arthur Henry Anson in priority of the provisions of my will for the term of her natural life and after reverts to the use of my daughter.

And whereas I have since the execution of my will purchased the residue of forty years of the leasehold of 10 Stanhope Street which will expire in 1885 I now bequeath the same to my trustees for my said wife for her to occupy or let out during her lifetime and then to my said daughter Augusta Theresa.

I also give and bequeath unto the said Edward Carleton Tufnell, sole executor of my said will, all that piece of plate which was presented to me by certain members of the House of Commons and which is designed as a centre piece for a dining table upon trust that he, the said Edward Carleton Tufnell, allow my said wife to have the use and custody and use of the same during her life and then to be kept by him as a family heirloom.

29 Feb 1852.

I also give and bequeath my said brother Edward Carleton Tufnell after the decease of my wife the portrait of Sir William Halton, Baronet, painted by Vandyke and the sapphire ring which is supposed to be the one represented in the picture, also the portrait of Sir William Hutchinson, also the two silver gilt baskets with glass inside used by me at dessert, also the two water ewers with silver gilt handles and ornaments and the two silver gilt sugar basins and spoons all subject to the life interest of my said wife.

I also give and bequeath the sum of £300 free of legacy duty to the London City Mission Society.

Henry married Anne Augusta Wilmot-Horton, daughter of Sir Robert John Wilmot 3rd Bart and Ann Beatrix Horton, in 1830. Anne was born on 16 Aug 1810 in Catton Hall, Catton, Derbyshire and died on 16 Jul 1843, aged 32.

30.  Edward Carleton Tufnell (William 4, George 3
Samuel 2, John 1) was born on 27 Oct 1806 in
Chichester, West Sussex and died on 3 Jul 1886, 
aged 79.

General Notes: He was educated at Eton College and 
Balliol College, Oxford, gaining a first class in
mathematics.

He became a commissioner for the Royal Commission on the Poor Laws in 1832. From 1835 to 1846 he was an assistant commissioner to administer the poor law, the new Poor Law having been passed in 1834. Together with James Kay-Shuttleworth, whom he had met as secretary of the Statistical Society of London (founded 1834), in 1839 they jointly published reports on the training of pauper children. In 1840 the Battersea Normal College for the training of teachers of pauper children was founded. This became the College of St Mark and St John at Chelsea, London and is now Plymouth Marjon University (also known as 'Marjon'). This was the first training college for school teachers in the United Kingdom. Today's system of national school education, with public inspection, trained teachers and its support by state as well as local funds, is largely due to their initiative.

32.  Rev John Charles Fowell Tufnell (John "Charles" (Lt Col) 4, George 3, Samuel 2, John 1) was born on 11 Feb 1797 in Seend, Wiltshire and died on 7 Oct 1866, aged 69.

Edward Jennings, born 28 Aug. 1793, at Kelvedon, co. Essex, is eldest son of David Jennings, Esq., of Ballingrove, Ireland, a Captain in the Army, by Mary, eldest daughter of Colin Campbell, Esq., of Jamaica.

This officer entered the Royal Naval College in Aug. 1805; and embarked in Jan. 1809, as Midshipman, on board the Valiant 74, Capts. John Bligh, Thos. Geo. Shortland, John Nash, and Robt. Dudley Oliver. After witnessing Lord Cochrane's destruction of the shipping in Aix Roads, sharing also in the attack upon Flushing, and serving off Rochefort and L'Orient, he successively joined, in 1811-12, the Christian VII. and Impregnable, both flagships in the North Sea of Admiral Wm. Young, and the Inconstant 36, bearing the broad pendant of Commodore Edw. W. C. R. Owen. During a winter-cruize of three months in the latter ship among the Western Isles, in 1812-13, Mr. Jennings, who had passed his examination in Sept. 1812, had charge of a watch, and was employed, with the Dublin 74, in search of an American squadron. On 27 May, 1813, he was appointed Acting-Lieutenant of the Calliope 10, Capt. John M'Kerlie, under whom we find him stationed in the river Elbe during the occupation of Hamburg and Cuxhaven by the French. In the following Sept. he joined the Richmond 12, Capt. Edw. O'Shaughnessy, into which vessel, it appears, he had been confirmed by commission bearing the same date as his acting order. Mr. Jennings' next appointment was, 27 March, 1814, to the Niobe 38, commanded at first by Capt. Wm. Augustus Montagu as an Active frigate on the Lisbon station, and afterwards as an hospital and troop ship by Capt. Henry Colins Deacon; under whom he conveyed the sick of the Russian Imperial Guards to Cronstadt, and, independently of a participation in several particular services, assisted at the reduction of Guadeloupe in 1815. The Niobe being paid off in March, 1816, he was afterwards employed in command – from 24 Nov. 1823 until June, 1828, again from 6 June, 1834, until Feb. 1839, and from the latter date until March, 1842 – of the Plover, Tyrian, and Alert packets, on the Mediterranean, North and South American, West India, and Lisbon stations.

Lieut. Jennings is the author of a nautical work of great practical utility, teeming with instruction to officers of all ages, stamped with the approbation of the Lords of the Admiralty, and adapted as well to the merchant as the naval service. He married, 17 Dec. 1818, Mary Jane, eldest daughter of Lieut.-Col. J. C. Tufnell, of Bath, by whom he has issue three sons and two daughters.

35.  Frances "Fanny" Tufnell (John "Charles" (Lt Col) 4, George 3, Samuel 2, John 1) was born on 13 Apr 1804, was baptised on 24 Apr 1804 in Marylebone, London, and died in 1857 in Hastings, East Sussex, aged 53.

General Notes: I, Frances Keays, now temporarily residing at 9 Queens Terrace, Bayswater in the county of Middlesex, widow of the late Ven Robert Young Keays, clerk, Archdeacon of Bombay in the East Indies and senior chaplain of Bombay aforesaid hereby revoke all wills and codicils by me heretofore made and I declare this to be my last will and testament.

I appoint my oldest son, Charles Frederick Keays, my brother, the Rev Edward Wyndham Tufnell, clerk Rector of Beechingstoke near Devizes, Wiltshire and William Colleen, esquire, surgeon in the service of the EICo to be executors of this my will.

I bequeath to my daughter, Frances Bates Colleen the sum of one thousand pounds and all my jewellery, shawls, wearing apparel, books, china, ivory boxes and household furniture of every kind.

Frances married Ven Rev Robert Young Keays on 19 May 1823 in Lacock, Wiltshire. Robert was born in 1799 and died on 11 Mar 1855, aged 56.

37.  Rev Edward Wyndham Tufnell (John "Charles" (Lt 
Col) 4, George 3, Samuel 2, John 1) was born on 3 Oct 
1814 in Bath, Somerset and died on 3 Dec 1896, aged 
82.


General Notes: Tufnell was born on 3 October 1814 in 
Bath, Somerset and educated at Eton and Wadham 
College, Oxford.

Ordained a priest in 1839, his first posts were 
curacies at Broadwindsor and Broad Hinton. After this 
he held incumbencies at Beechingstoke and Marlborough.

He served as Anglican Bishop of Brisbane from 1859 to 
1874.

While in Brisbane in 1863, Edward Tufnell 
commissioned architect Benjamin Backhouse to build 
the house Riversleigh on North Quay as an investment.

Tufnell returned to England in 1874. In 1882 he 
became the vicar of Felpham near Bognor Regis and in 
1888 he paid for the school to move to a new site in 
Felpham Way. The school is still named after him but 
moved again in 1957. The rector's vestry at St Mary's 
Church was erected in 1899 as a memorial to him.

Tufnell married his cousin, Laura Tufnell, who was 
the daughter of John Jolliffe Tufnell of Langleys, 
Great Waltham, Essex. They had two children: 
Arthur Wyndham Tufnell, who was murdered in 
India while travelling on a train to Simla; and Ida 
Mary Uliana Mary Tufnell, who married Henry 
Arthur Wansbrough, a priest. Ida was the 
grandmother of the Benedictine monk and scholar, 
Dom Henry Wansbrough.

Tufnell died on 3 December 1896.

38.  Thomas Jolliffe Tufnell (John "Charles" (Lt Col) 
4, George 3, Samuel 2, John 1) was born on 3 May 
1819, was baptised on 18 Jun 1819 in Chippenham, 
Wiltshire, and died on 27 Nov 1885, aged 66.

General Notes: Tufnell was the fifth son of John 
Charles Tufnell, lieutenant-colonel of the 
Middlesex militia, by his wife Uliana Ivaniona, 
only daughter of John Fowell, rector of 
Bishopsbourne, Kent. 

He was born at Lackham House, near Chippenham, 
Wiltshire, on 23 May 1819. He was educated at Dr. 
Radcliffe's school at Salisbury, and was apprenticed 
in 1836 to Samuel Luscombe of Exeter, then senior 
surgeon to the Devon and Exeter Hospital. Tufnell 
proceeded to London after studying at Exeter for 
three years, and entered at St. George's Hospital 
under Sir Benjamin Collins Brodie and Cæsar 
Hawkins.

He was admitted a member of the College of 
Surgeons of England in May 1841, and on 11 June in 
the same year he entered the army as assistant 
surgeon to the 44th regiment, then serving in India. 
He proceeded to Calcutta, and took medical charge of 
all the troops as they arrived from England, 
remaining for this purpose at Chinsurah until the 
last detachment had landed at Christmas. By this 
delay he was hindered from participating in the 
disastrous campaign in Afghanistan in 1842, in which 
the 44th regiment was almost annihilated.

He returned to England in October, and was posted 
to the 3rd dragoon guards, with whom he served at 
Dundalk, Dublin, and Cork. In 1844 he was married, 
and determined to leave the service and settle in 
private practice. On 14 April 1846 he accordingly 
obtained his transfer to the army medical staff at 
Dublin, and shortly afterwards accepted as a life 
appointment the post of surgeon to the Dublin 
district military prison. He was admitted in 1845 the 
first fellow by examination of the Royal College 
of Surgeons of Ireland, and in 1846 he fitted up a 
class-room and lectured on military hygiene. 

He also lectured upon this subject at the St. Vincent 
and Bagot Street hospitals until his appointment as 
regius professor of military surgery in the College 
of Surgeons in 1851. He lectured in this capacity 
until 1860, when the chair was abolished by the 
government as a result of the foundation of the 
Netley military school. Tufnell again saw service; 
for in the war between Russia and Turkey, after 
passing down the Danube in 1854, he went to the 
Crimea with a Scottish regiment. He acted as an 
examiner in surgery at the Royal College of 
Surgeons in Ireland, but he resigned the post on 
becoming a candidate for the office of vice-
president in 1873. He served the college as 
president in 1874–5, and he was for more than 
twenty years surgeon to the City of Dublin 
Hospital.

He died on 27 November 1885, and is buried in 
Mount Jerome cemetery, near Dublin. In 1844 he 
was married to Henrietta, daughter of Croasdaile 
Molony of Granahan, and widow of Robert 
Fannin. By her he left two daughters: Ivamarried 
to Peter Leslie Peacocke; and Florence, married 
to Thomas Turbitt of Owenston.

Tufnell wrote: 1. 'Practical Remarks on the 
Treatment of Aneurism,' Dublin, 1851, 8vo. 2. 
'The Successful Treatment of Internal Aneurism,' 
London, 1864, 8vo; 2nd edit. 1875. He also 
devised various surgical instruments.

Thomas married Henrietta Molony in 1844.

39.  Thomas Robert Tufnell (John "Charles" (Lt Col) 4, George 3, Samuel 2, John 1) was baptised on 26 Oct 1822 in Lackham House, Chippenham, Wiltshire and died on 1 Apr 1898 in Ouchy, Switzerland, aged 75.
